The Association des propriétaires d’autobus du Québec (the « APAQ » [Quebec Bus Owners’ Association]) welcomes you to our Portal www.espacebus.ca. Espacebus.ca is not a corporate body, but rather a trademark under which we operate our Portal.
ACCEPTANCE AND MODIFICATION OF THE CONDITIONS OF USE
Use of the Portal implies the acceptance of the conditions of use set out in this document. These may be modified at any time. It is therefore suggested to refer to them regularly.
PERSONAL USE
The Portal is at the disposal of Internet users exclusively for personal use and not for commercial use.
PORTAL CONTENT
Unless otherwise indicated, the content of the pages of our Portal is presented for information purposes only and does not constitute a contract commitment on our part.
The information found on our Portal comes from numerous external sources. The APAQ has expended all possible efforts to ensure accuracy, timeliness and reliability of the Portal’s content. The Portal’s information is updated regularly. However, on occasion certain recent modifications may not appear. Should that occur, please advise us.
Any information provided concerning a business, a product or a service within the Portal in no way means that we endorse it or do not recommend it.
USE OF THE PORTAL
Any illegal use, directly or indirectly, of the services offered by our Portal is strictly prohibited.
Harassment on the Portal, in any form whatsoever is prohibited. It is also forbidden to disrupt our employees, hosts, representatives or any other members or visitors of the Portal or to wrongfully use their name or identity.
Attempts to access or accessing of areas protected and reserved to our personnel or for users registered with the Portal is strictly forbidden. Any violation or attempt to violate access protected by a restricted password will automatically bring about lawsuits against the offender.
COPYRIGHTS AND TRADEMARKS
All content posted on the current Portal, including texts, images, graphics, interfaces, photos, videos, codes, content option and layout (the “Content”), or otherwise accessible through the Portal is protected by Copyright. The Content published on the current Portal and the Copyrights on the Content belongs or is under the control of the APAQ or their Content suppliers. Any use, reproduction, broadcast, publication or retransmission of the Content, in whole or in part, is strictly forbidden without our written and prior authorization or the authorization of the Copyright holder.
The names of products, services, companies and logos mentioned in the Portal may be trademarks, filed or not by their respective owners, and protected accordingly. It is therefore forbidden to use any trademark contained on the Portal without our written and prior authorization or the authorization of the right holder concerning that Trademark. COMMUNICATIONS
If you forward any notes, messages, ideas, suggestions or you submit concepts, you accept to assign your rights and renounce to all related moral rights for the duration of the right, perpetually, irrevocably, everywhere in the world. This assignment overrides rights to post, under any manner whatsoever, including for promotional and advertising purposes.
LINKS WITH OTHER SITES
The Portal includes links towards other Internet sites. Inasmuch as the APAQ cannot control these sites, it is unable to guarantee the exactness and exhaustiveness of the contents, advertisements, products, services or any other material available on or from these sites. Furthermore, the APAQ cannot be held responsible for any damage or loss, proven or alleged, resulting from or associated with the use or with the fact of having trusted as to the content, for goods or services available on these Internet sites.
CONFIDENTIALITY
Refer to the Declaration of Confidentiality of the current Portal.
LIABILITY EXCLUSION AND LIMIT
No advice and no information obtained while using the Portal are likely to create guarantees.
The APAQ cannot pledge its liability with regard to information transmitted on the Portal.
Under no circumstance, except gross negligence, can the APAQ be held liable for any loss or damages that could be closely or by far related to the tardiness or delays inherent to the use of this Portal, to the reliability of the data available, to be unable to use the Portal and to the involuntary inoculation of a virus at the user’s entry port.
The user undertakes to keep the APAQ free of and protected in full from damages, costs and expenses, reasonable lawyer fees included, related to any violation of the conditions herein either by the user himself or by the users of his account, either in relation with the use of this Portal or upon the broadcast or the transmission of any violation or other elements on this Portal by the user himself or the users of his account.
We in no way guarantee around-the-clock operation of services or access to such services. We offer no express or implicit guarantee of any nature whatsoever with regard to services including, but without limiting the number and the range, any guarantee with regard to the transmission capacity of telecommunication businesses and of the service provider or of the reliability of telecommunication businesses’ equipment or the service provider’s equipment or alternately the exactness or the relevance of the information made available by the services or equipment. The APAQ cannot be held liable for damages resulting from the use of the services or equipment, nor from errors, omissions, interruptions, delays or defectiveness concerning the services and the equipment or the data provided by the services and the equipment.
The Portal user accepts the Portal’s conditions of use and understands that by using the information provided, he cannot hold the APAQ liable for damages or losses that he may sustain following his decision to do business with one of the businesses named in this Portal and with which he may do business via an external site.
APPLICABLE RIGHT
The conditions of use herein are governed by the laws in effect in the Province of Quebec, and any litigation must be submitted to competent Courts in the Province of Quebec, in the District of Quebec. If one of the provisions of the conditions of use is deemed to be invalid by a competent Court, it shall not have as effect to render invalid all the other provisions, the invalid provision to be dissociated from the other provisions of the conditions of use herein, which shall remain in effect.
The conditions of use herein and any other legal notice posted on our Portal constitute the agreement existing between us with regard to the use of the Portal and its content.
